Decision:

As Mr Goindasamy admitted the breach the Committee found the charge proved. 

Penalty:

The Committee granted Mr Goindasamy a deferment to his suspension pursuant to Rule 1106(2). Accordingly, his licence to ride in races is suspended for a period of 7 days commencing after racing on the 3rd April 2021 and concluding after racing on 14th April 2021. In addition, we impose a $500 fine.

Facts:

This charge arises from the running of Race 2, the Betavet 2100. Stipendiary Steward, Mr Coles filed an Information pursuant to Rule 638(1)(d) alleging the rider of PEARL HEART (A Goindasamy),” allowed his mount to shift out when insufficiently clear of OH OUR WYATT, which clipped a heel and blundered near the 250m”.

Mr Goindasamy acknowledged he understood the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Using the available race films Stipendiary Steward, Ms Selvakumaran demonstrated the incident and identified the horses and riders concerned; PEARL HEART (A Goindasamy) and OH OUR WYATT (Taiki Yanagida).

Ms Selvakumaran said that at about the 350m Mr Goindasamy was held up for a run. Approaching the 250m he made a decision to shift out when there was no run available to him. As a result he interfered with OH OUR WYATT which clips a heel and blunders badly. Ms Selvakumaran added that Mr Goindasamy was only a bare length clear when he shifted outwards.

Mr Williams assisting Mr Goindasmy said that Mr Goindasamy clearly shifted outwards (causing interference), but added that other runners were also running around.

Mr Goindasamy said that he may have panicked a little after having to ease out of a gap and then shifted outwards in an attempt to gain a run for his horse.

Submissions for Penalty:

Mr Coles produced Mr Goindasamy’s riding record which indicated 3 previous breaches under the careless riding Rule in the last 12 months. These breaches had occurred over approximately 488 rides, with today’s breach being his 4th charge.

Mr Coles said Stewards assessed the level of carelessness to be in the mid-high range. A horse has been badly hampered and the rider could have been dislodged.

In response Mr Williams asked if the Committee could consider Mr Goindamsamy’s good riding record and also the fact that there were horses running around that may have contributed to the incident.

Mr Goindasamy had nothing to add in relation to penalty submissions and sought a deferment to any proposed suspension until after racing on 3rd April 2021.

After considering the submissions and reviewing the race film the Committee determined Mr Goindasamy’s carelessness to be in the mid to high range and adopted a 7-day (suspension) and $500 (fine) as the starting point.

The Committee viewed the head-on, side-on and back-on films which established that Mr Goindasamy allowed his mount to shift out when looking for a run. At no stage during this outward movement was he more than 1 length clear of the trailing horse OH OUR WYATT who was placed in restricted room for a number of strides before eventually clipping a heel and almost falling. Of concern to the Committee was the fact that at no stage during the outward shift did Mr Goindasamy look over his shoulder to identify if he was likely to interfere with any other runner.

Mr Goindasamy’s riding record was assessed as being a neutral factor as his 4 breaches (this being his 4th) had occurred over 488 rides.
