Decision:

Following Race 7, a protest was lodged by Stipendiary Steward Mr M Williamson, pursuant to Rule 876 (1).  He alleged that LOVE ON THE ROCKS or its rider placed 4^th by the judge caused interference to TOEY ZOE  placed 5th by the judge.  The interference occurred in the final 100 metres, the official margin between 4^th and 5^th was a neck.

Present were Mr P Busuttin and rider J Nisbah representing LOVE ON THE ROCKS.

Ms L Skinner and rider Ms J Morris represented TOEY ZOE.

Mr J Oatham demonstrated the video films and showed from the 200 metre mark, when TOEY ZOE was racing 2 lengths behind LOVE ON THE ROCKS and making up good ground along the inner to get within a neck of that horse at the 75 metre mark, when Ms Morris was hampered by the inward movement from LOVE ON THE ROCKS, she was unable to ride her mount out and lost considerable ground and momentum.

Mr P Busuttin said there was no doubt his horse had shifted in, but felt TOEY ZOE was not going good enough to take the gap.

Mr J Nisbah said his horse ran in at the 100 metre mark when the horse WHISPER came alongside his mount.

Ms J Morris said she was making up good ground and was unable to ride her mount out due to interference received from Mr Nisbah’s mount, costing her 4^th placing.

Ms Skinner said it was a quite dramatic move inward by LOVE ON THE ROCKS after viewing the head on film.

Mr Williamson, in summing up, said given the ground that TOEY ZOE had made up from the 200 metres, he believed that had the interference not occurred TOEY ZOE would have finished in front of LOVE ON THE ROCKS.

Decision

The Committee carefully considered all the evidence and reviewed the films.  We are clearly satisfied that TOEY ZOE did suffer interference in the final 100 metres, when LOVE ON THE ROCKS moved inwards into TOEY ZOE’s line causing it to be checked and lose momentum.

The Committee has no doubt had TOEY ZOE not received the interference from LOVE ON THE ROCKS it would have finished in front of that horse.  Accordingly the protest is upheld and the placings are now:

2^nd   4   KILIFI

3^rd    8  WHISPER

4^th    6  TOEY ZOE

5^th    5  LOVE ON THE ROCKS
