Mr Cropp admitted the breach and was represented by Mr G McKeon.

Mr Coles said Mr Cropp could only claim 1.75 kg and not the full 4 kg allowance, he stated that although Mr Cropp was trying hard, he was struggling with his weight.

Mr Cropp had nothing to add.

Mr McKeon stated he was surprised that Mr Cropp was attempting to ride below 56 kg, and advised him to contact the Racing Bureau to inform them of his current weight.

Mr Coles submitted a fine in the range of $ 100 - $ 200 would be appropriate.

The Committee considered all submissions and before imposing a penalty highlighted to Mr Cropp it would be professional on his behalf to inform the Racing Bureau of his current weight, so this charge is not repeated in the future.

The September 2008 Thoroughbred Monthly shows Mr Cropp weight at 52 kg.

On this occasion a $ 150 fine was imposed.
