This Committee orders that Mr Bosson's Rider's Licence is suspended from the conclusion of Racing today up to the conclusion of Racing at New Plymouth on the 3rd of December 2020. We calculate that to be 7 National Riding days being Te Rapa, Otaki, Cromwell, Ellerslie, Cromwell, Rotorua and New Plymouth.
Facts:
Following the running of the BROKERWEB 1200 an Information was lodged by Chief Stipendiary Steward Mr JM Oatham against Mr OP Bosson the Rider of ROCH 'N' HORSE alleging that Mr Bosson angled his mount out near the 200 metres mark when not clear of HONG KONG'S FOLKS (Rider C Dell) which was crowded and checked and in turn it hampered SAINTLY WAY(Rider S Weatherley).
Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Bosson was present at the Hearing and he confirmed to the Committee his admission of the breach.
Stipendiary Steward Mr A Coles demonstrated the incident using the race films. He identified the 3 horses referred to in the Information. He showed where at the 200 metres mark Mr Bosson angled his horse out and it came into contact with HONG KONG'S FOLKS which suffered buffeting because there was not sufficient room on its outside and it resulted in that horse being pushed out onto SAINTLY WAY which in turn lay in. He said that as a result of the interference and buffeting Mr Dell had to check his horse.
Mr Coles further said that Mr Bosson attempted to ride into a marginal gap and was only half a length clear when he began angling outwards.
Mr Bosson said that he had made an error. He said that it was made worse because the horse in the purple colours in front of him rolled out when he tried to relieve the pressure. He said that pushed him wider than expected.
Submissions for Penalty:
Mr Oatham said that Mr Bosson has an excellent record under this Rule. He did say however that there was never a clear run for Mr Bosson's horse and when he tried to come out this resulted in significant and messy interference to the other runners.
He said that the interference was above mid range in terms of seriousness.
Mr Bosson said that he would like to start any suspension immediately.
Reasons for Penalty:
The Committee listened to the evidence and we have reviewed the race films. In our view there was never a proper gap for Mr Bosson to come through. The interference is a least mid range but it has caused quite significant checks to HONG KONG'S FOLKS and SAINTLY WAY.
In our view also Mr Bosson did not take any corrective action.
Mr Bosson has admitted the breach but that was inevitable given the very clear film evidence.
We have taken 8 National Riding days as a starting point penalty and we give Mr Bosson credit for his good record under this Rule and have therefore reduced the penalty to one of 7 National Riding days.
