The Committee having reviewed the films ruled that FAMILIA was denied a fair start and it was declared a non-runner.
Facts:
Following the running of the DUNSTAN FEEDS AUCKLAND THOROUGHBRED BREEDERS' STAKES an Information for a Request for a Ruling was lodged by Mr L Noble the Trainer of FAMILIA seeking a Ruling as to whether FAMILIA was denied a fair start.
The Information was lodged pursuant to Rule 632(1) which provides: If, in the opinion of the Judicial Committee, a horse which does not finish in the first four placings was prevented from taking an effective part in a Race owing to the mechanical failure of the starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord) the Judicial Committee may declare such horse to be a non-starter.
Mr Noble the Trainer of FAMILIA demonstrated the incident using the race films and he suggested that the Starter's Assistant had one hand on the reins when the gates opened. He said that the horse reared and the Starter's Assistant let go with his top hand but was still holding with the bottom hand.

Mr Innes the Rider of FAMILIA said that his horse was fractious in the Barrier and he asked the Starter to wait. He said that the Starter's Assistant had his hands on the reins as the gates opened.
Mr McGovern said the Starter's Assistant was trying to protect Mr Innes when his horse reared.
Mr Oatham said that it was an unfortunate situation with the horse rearing and no one was to blame. He said as the horse reared the Starter's Assistant had his hands on the reins and the gates opened. FAMILIA was held up jumping out of the gates.
Mr Oatham said that once the final starting call was given all hands should be released.

The race films show FAMILIA rearing in the starting gate and show the Starter's Assistant up alongside that horse and still holding a rein as the gates opened. It was unfortunate as Mr Oatham submitted because the Starter's Assistant was trying to help Mr Innes. The Starter's Assistant was however holding the rein when the gates opened and FAMILIA was slow away and was therefore denied a fair start.
