Charge:
Prior to the hearing Mr Coles produced a letter from the Racing Integrity Unit approving today's committee hearing the charge arising from the Counties RC meeting on 21st January 2012.
The informant Mr Coles filed an information pursuant to rule 638(1)(d).He alleged that near the 200 metres ARURITESON (C Dell) allowed his mount to shift out into the line of KULLU (L Innes) when not sufficiently clear causing KULLU to check. Hampered as a result was FASHION ROCKS (C Lammas).
Evidence:
Mr Williamson demonstrated the incident using the head on and side on films. He pointed out to the committee that Mr Dell allowed his mount to shift out into the rightful running line of KULLU when only 1/2 length clear. This resulted in KULLU and FASHION ROCKS being checked from the outward movement. He conceded that KULLU was reluctant to hold its position at the point of interference.
Mr Dell acknowledged the evidence put forward by Mr Williamson was correct and did not wish to cross examine his evidence.
Mr Dell submitted that he had gone for a gap that was marginal, however, conceded that his mount continued to roll out when not sufficiently clear. He said that KULLU was racing ungenerously at the time and contributed to the incident.
Mr Dell senior accepted the evidence presented.
Decision:
As Mr Dell admitted the breach we find the charge proved.
Submissions For Penalty:
Mr Coles produced Mr Dell's record which showed 1 previous suspension in the last 12 months. He submitted the degree of carelessness was in the low range and rated his riding record as good. He said Mr Dell should be given credit for his early admission of the breach and conceded that there were some mitigating circumstances that were in his favour. He advised the committee that Mr Dell does ride all over the country. He believed a suspension at the low end of the scale would be appropriate.
Mr Dell submitted to the committee that he rode in the South Island during December 2011 and January 2012. Mr Dell said he had firm commitments up to and including 18 February 2012. He acknowledged that a 4 day suspension was an appropriate penalty.
Mr Dell senior agreed with the submissions presented, particularly the mitigating circumstances.
Reasons For Penalty:
The committee carefully considered all the evidence and submissions presented. The mitigating factors are Mr Dell's admission of the breach and his very good riding record. However the films clearly show that Mr Dell was not the required distance clear when shifting ground. We accept that Mr Dell does ride all over the country.
Penalty:
We grant Mr Dell's submission to seek a deferment to his suspension as per rule 1106(2).
Accordingly we impose a suspension on Mr Dell which will commence after racing on 18th February 2012 and to conclude after racing on the 24th February 2012 (4 days)
