The margins were 1/2 length/ 1 1/4/ short head and 3/4 length.
Following race 6 a protest was lodged by the informant Mr A Scott trainer of the 5th horse PENNACCHIO against the second place horse COOL STORM. The protest came pursuant to rule 642 (1). The interference was alleged to have occurred in the final stages of the race.
Submissions for Decision:
Mr Scott demonstrated the video films and pointed out to the hearing his horse PENNACCHIO receiving interference from COOL STORM at the 50 metre mark. He said PENNACCHIO had come from 6 - 7 lengths behind COOL STORM after turning for home and continued making ground in the run to the post. Mr Scott stated that PENNACCHIO could have pegged COOL STORM back if she had not received the check.
Mr Ormsby rider of PENNACCHO said that at the 40 metre mark he was up to the flank of COOL STORM when he had to grab the left rein and steer his mount out to avoid interference. He stated he could have possibly passed COOL STORM if he hadn't had to check.
Mr Du Plessis rider of COOL STORM said that at the 250 metre mark he had to change his stick hand because his mount seem to be shying away from something in the infield. He said he had to stop riding for 5 strides in the last 50 metres to try and keep his mount straight which he believed cost him winning the race. Mr Du Plessis also stated that PENNACCHIO did not gain any ground on COOL STORM from the 200 to the 30 metre mark.
Mr S McKee trainer of COOL STORM concurred with Mr Du Plessis in that PENNACCHIO did not make any ground on COOL STORM until 25 metres from the post. He said from this stage it was too close to the finish and in fact COOL STORM had maintained its margin to the post.
The owners of PENNACCHIO, Mr & Mrs Norwood, did not have anything to say when asked.
Mr Oatham when asked for his assessment said it was clear that PENNACCHIO did not make any ground on COOL STORM in the run up to the straight. At the 30 metre mark when COOL STORM did come out Mr Oatham believed the check to PENNACCHIO was too close to the post to warrant a change of place.
Mr Scott when summing up said Mr Ormsby had to stop riding well before the interference occurred and in his opinion COOL STORM was getting tired and PENNACCHIO was making ground at the finish.
The defendant, Mr McKee did not have anything further to add.
Reasons for Decision:
The committee carefully considered all evidence and reviewed the films. While we concede that PENNACCHIO did receive interference from COOL STORM at the 30 metre mark we believe that interference was too close to the post to make any difference to the outcome of the race. It was also clear on the films that PENNACCHIO was not gaining ground on COOL STORM over the final 200 metres. For these reasons we are not satisfied that PENNACCHIO would have beaten COOL STORM if interference had not occurred. Another important factor the committee took into account was the margin of 2 lengths between 2nd and 5th at the post.
