As Ms Grylls admitted the breach we find the charge proved.
Penalty:
Accordingly, we impose a suspension on Ms Grylls which will commence after racing on 23rd February and conclude after racing on 8th March 2013 (7 North Island days).
Charge:
Following race 6, an information was filed pursuant to Rule 636(1)(c). The informant, Mr Coles alleged that Ms B Grylls failed to ride MEMORY out to the end of the race when there was a reasonable chance of it finishing in a better position.
Mr Coles read the rule and Ms Grylls acknowledged that she understood the seriousness of the charge. The Committee gave Ms Grylls the opportunity to adjourn the Hearing but she said that she had no objection to this being heard on race day.
Facts:
Mr Williamson advised the Committee that MEMORY was officially placed 5th and was a head and a head away from finishing in 3rd position.
Mr Williamson demonstrated the incident by using all the available films. He pointed out to the committee that at the 100 metre mark MEMORY was racing in third position against the running rail. He said just short of the finish Ms Grylls relaxes her ride for 3 strides. He advised the Committee that the track does turn approximately 10 metres prior to the winning post. He added this was a mitigating factor in this charge.
In response to a question from the Committee, Mr Williamson believed that it may have cost MEMORY 3rd position.
Ms Grylls told the Committee that she had not ridden at Counties previously and believed she had already past the finish line when she relaxed her mount.
Mr Hawtin said the video films clearly showed that the running rail was deceiving. He concurred with the Stewards that this was a mitigating factor in Ms Grylls' actions.
Mr Coles in summing up informed the Committee MEMORY underwent a post race veterinary examination which failed to find any abnormalities.
Submissions for Penalty:
Mr Coles produced Ms Grylls' record which showed she had a clear record under this rule. He said Ms Grylls had been riding for approximately 8 months and had only 1 previous careless riding charge. He submitted Ms Grylls does travel all over the North Island and should be given credit for her admission of the breach. He said it was a “trap” with the rail turning away approximately 10 metres before the winning post and acknowledged this was a mitigating factor. However, he submitted that all riders have an obligation to ride their mounts out to the finish of a race. Mr Coles referred to similar recent penalties imposed under this rule and submitted the Committee should determine an appropriate penalty based on them.
Ms Grylls submitted that she had firm commitments up to and including 23rd February at Otaki and requested a deferment to her proposed suspension. Ms Grylls when asked by the Committee submitted she had no intention of riding at Omakau, Cromwell and Christchurch in March.
Mr Hawtin said that he would let the Committee determine an appropriate penalty based on other breaches.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The mitigating factors for Ms Grylls are her clear record, her admission of the breach, her lack of experience on the track, the unusual nature of the track which was clear to the Committee when reviewing the films and her co-operation with Stewards. We believe Ms Grylls showed genuine remorse. The aggravating factor is that this is a reasonably serious charge in which the betting public were potentially let down by Ms Grylls' actions. We independently reviewed the video films which showed Ms Grylls eased up for 3 strides just prior to the finish. The fact Ms Grylls was beaten a head and a head for 3rd place is also an aggravating factor.
We are of the view that there was no intent on Ms Grylls' part in the manner she rode the horse.
In determining penalty, the committee had regard for the need to maintain integrity and public confidence in racing. We note that the JCA penalty guide recommends a starting point of 3 weeks, with regard being had to the placing involved. We referred to the JCA listing of penalties for similar breaches before imposing penalty. This showed 2 recent suspensions for apprentice riders similar in many respects, the penalties imposed were 7 and 11 days.
After taking into account all the above factors and placing emphasis on the mitigating factors we assess an appropriate penalty is a suspension of 7 North Island Days. We note 2 of these days are at premier level.
