FACTS:
--Stipendiary Steward Mr J OATHAM showed the video film of the race at about the 150metre mark from the finish line. He said HEYDENTAL TOURIST ridden by Ms SATHERLEY moved inwards about 3 horse widths and took the line of MAGIC GEM ridden by Ms N COLLETT causing that horse to be restrained and lose momentum. He said Ms SATHERLEY continued to ride her horse out whilst it was moving inwards. He said the chances of MAGIC GEM were affected by the incident.

Ms SATHERLEY said her horse hit a dip, got tired, stumbled and ran in. She acknowledged however that she had “kept riding” the horse.

SUBMISSION(s) ON PENALTY:
--Mr COLES referred to Ms SATHERLEY’s admission of the breach and also that she had no breaches of the rules recorded against her in the last 12months. He said the offending was at the lower end of the scale and submitted that the minimum penalty of 4 days suspension was appropriate.

Ms SATHERLEY accepted the submissions of Mr COLES.

REASON(s):
--In fixing penalty the committee takes into account the admission of the breach, the submissions of Mr COLES and Ms SATHERLEY’s acceptance of them, the offending was mid – lower end on the scale of seriousness, Ms SATHERLEY’s clear riding record and the policy of the minimum penalty being a suspension of 4 days.

PENALTY:
--For the above reasons the committee is satisfied that a suspension of Ms SATHERLEY’s riders licence for 4 days is appropriate. Accordingly her riders licence is suspended from the end of racing today until the end of racing on the 9th June 2010.
