As the breach was admitted we find the charge proved.
Penalty:
The committee is aware that Mrs Allpress will be serving a 3 day suspension which commences after today's racing 19 November and concludes after racing on 24 November. Mrs Allpress was within her rights to take rides on 25 and 26 November as her suspension would have concluded. Accordingly we impose a suspension on Mrs Allpress from riding in races which is to start after racing on 26 November and conclude after racing on 2 December 2011 (4 days). This deferral comes pursuant to rule 1106.

Facts:
Following race 1 an information was filed pursuant to rule 638(1)(d). The informant Mr J Oatham alleged that passing the 400 metres Mrs L Allpress riding LADY KIPLING allowed her mount to shift in crowding AGAMEMNON which was checked and forced inwards hampering JUSTA KINDA MAGIC which blundered.
Submissions for Decision:
Mr Coles demonstrated the video films which clearly showed LADY KIPLING racing in a 3 wide position at the 400 metres. It was then evident that Mrs Allpress allowed her mount to move in sharply on to AGAMEMNON when insufficiently clear. This resulted in a sharp check to AGAMEMNON who clipped heels causing it to run in the line of JUSTA KINDA MAGIC. Mr Coles stated that Mrs Allpress continued riding forward without attempting to straighten her mount.
Mrs Allpress in admitting the breach said she was travelling well and it was an error of judgement on her part.

Mr Oatham said Mrs Allpress had incurred 4 suspensions in the last 12 months which was a good record for the large number of rides she has. He said the movement was not great and submitted her carelessness was at the low end of the scale.
Mrs Allpress said she had commitments for 25 and 26 November which she had accepted prior to today's race meeting.

The committee carefully considered all evidence and submissions. In Mrs Allpress' favour she had admitted the breach and has a good riding record. Further we are satisfied that on this occasion her carelessness was at the low end of the scale.
