As Mr Bosson admitted the breach we find the charge to be proved.

Penalty:

Accordingly we impose a fine of $400.

Charge:

Following Race 9 the informant Mr Coles lodged an information pursuant to Rule 330(3)(c). He alleged that Mr Bosson failed to make the contracted weight for CASTLETON KING.

Facts:

Mr Coles said Mr Bosson, the declared rider for CASTLETON KING, was unable to make the handicapped weight of 56kg's. He said Mr Bosson was plus 0.75kg's and was replaced by Mr C Grylls.

Mr Bosson told the Committee he went for a sauna during the race meeting in an attempt to lose weight, this was unsuccessful. Mr Bosson said he had a busy week riding the 3 previous days and believed his body was retaining fluids.

Submissions for Penalty:

Mr Coles produced Mr Bosson's record which showed this was his 5th charge under the Rule in the last 12 months. The previous penalties ranged from $100 to $300 fines. He said Mr Bosson has previously struggled with his weight and submitted a fine of not less than $400.

Mr Bosson when asked for submissions on penalty had nothing to say.

Reasons for Penalty:

The Committee carefully considered all evidence and submissions presented. The only mitigating factor was Mr Bosson's admission of the breach. We acknowledged that Mr Bosson did attempt to lose some weight on race day. The aggravating factor was this is Mr Bosson's 5th charge under the Rule in the last 12 months. The Committee highlighted to Mr Bosson he was a premier rider who disadvantaged owners, trainers and the betting public when he fails to make the contracted weight. We advised Mr Bosson with his poor record any further breaches of this Rule may result in a suspension rather than a fine.
