Charge:
Following race 8 the informant Mr A Coles lodged an information pursuant to rule 614(2). He alleged that Mr P Duncan presented ZLATO to race with the incorrect saddle cloth.
Facts:
Mr Coles said Mr Duncan was negletful in not checking he had the correct saddle cloth numbers. Mr Duncan had presented ZLATO at the plate inspection with the wrong saddle cloth number. He had two runners in the event and made an error in placing the wrong saddle cloth numbers on ZLATO and INDIAN SKY. The error was found at the plate inspection by Mr W Robinson who ordered them both back to be resaddled.

Mr Coles said similar cases have resulted in a fine of $150. He said Mr Duncan had a clear record under this rule.

The committee carefully considered all evidence and submisssions presented. We referred to the JCA listing of penalties which confirmed a fine of $150 would be appropriate. The mitigating facor was Mr Duncan's clear record under this rule. The aggravating factor was that Mr Duncan was neglectful in his duty as a licensed trainer.
