As the breach was admitted we find the charge proveD.

Penalty:

After balancing the above factors we impose a fine of $150. Miss Collett was advised by the Committee any further breaches of this Rule would result in a higher penalty.

Charge:

Following race 4 the informant Mr Coles lodged an information pursuant to Rule 638(3)(b).He alleged that Miss Collett used the whip on GOLD HUNTER in an excessive manner.

Facts:

Mr Williamson demonstrated the video films and pointed out to the Committee Miss Collett striking her mount 12 times prior to the 200 metres, Mr Williamson submitted that Miss Collett failed to give her mount the required respite.

Miss Collett said she simply misjudged the length of the final straight and was trying to kept her mount going forward in the heavy track conditions.

Submissions for Penalty:

Mr Coles produced Miss Collett's record which showed no previous breaches of this Rule in the last 12 months. He submitted this breach would normally warrant a fine of $200, however with Miss Collett's admission of the breach and and her excellent record a small concession was an appropriate penalty.

Miss Collett had nothing to add.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. We explained to Miss Collett that the JCA penalty guide starting point for excessive whip use is $300, this can be adjusted up or down based on mitigating and aggravating factors.The mitigating factors are as follows,Miss Collett's excellent record, her admission of the breach, we have assessed the breach to be at the low end of the scale. The aggravating factor was Miss Collet failed to give her mount the required respite.
