An information was filed pursuant to Rule 1002 when Ms D Johnson was charged with failing to wear an approved vest while riding trackwork at the Counties Racing Club on the morning of 18 April 2008.

An information was filed pursuant to Rule 1002 when Ms D Johnson was charged with failing to wear an approved vest while riding trackwork at the Counties Racing Club on the morning of 18 April 2008.
--Ms Johnson was represented by her employer, Mr G McCrae. Ms Johnson pleaded guilty to the charge.
--Chief Racecourse Inspector Mr J McKenzie told the Committee that Chief Stipendiary Steward Mr C George attended the trackwork this morning at 6:45 am and noticed that Ms Johnson was not wearing a vest. When he questioned Ms Johnson she told Mr George she was wearing a vest and it was only upon further investigation she admitted she was not.
--Mr McKenzie stated that should Ms Johnson re-offend under this Rule requiring an approved vest, she would have her licence removed. He said this was to be her last chance. He submitted that a fine of $350 - $500 would be the appropriate penalty.
--Ms Johnson had nothing to say.
--Mr McCrae said Ms Johnson was often reluctant to wear a vest and he had experienced trouble for some time getting her to do so.
--PENALTY
--The Committee considered all evidence and before imposing penalty told Ms Johnson it was disappointing to hear her employer, Mr McCrae, say this offending had been going on for some time. We also take a serious view of Ms Johnson lying to Mr George, initially telling him she was wearing a vest and then upon further questioning admitting she was not.
--We concur with Mr McKenzie that this should be Ms Johnson's last warning concerning the wearing of an approved vest and next time will be treated as a serious racing offence and therefore putting her licence in jeopardy.
--Taking all the above into account we impose a fine of $450.00.
