Following race 4 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendary Steward Mr M Williamson that Mr A Peard permitted his mount OPULANCE to shift outwards near the 400 metres when not sufficiently clear of DRUZE (J McDonald) who clipped a heel and blundered badly.

Following race 4 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendary Steward Mr M Williamson that Mr A Peard permitted his mount OPULANCE to shift outwards near the 400 metres when not sufficiently clear of DRUZE (J McDonald) who clipped a heel and blundered badly.

Mr J Oatham demonstrated the videos.  He showed the field as it entered the front straight.  DRUZE was running on OPULANCE’s outer and no more than one length back.  The horses swung wide and then, on straightening, OPULANCE continued to move out and take the line of DRUZE who clipped heels and nearly dislodged rider McDonald.  At no time was Mr Peard the required distance clear of DRUZE.

As Mr Peard admitted the charge the committee is required to adjudicate on penalty only.

Mr Williamson said Mr Peard was never clear of DRUZE and Mr McDonald was very lucky to keep his seat especially as the saddle shifted in the incident. He said that Mr Peard had just started riding again after an 11 month recuperation after injury and he had admitted the charge.  Mr Williamson asked for a suspension in the 4 – 6 day range.

After considering the grade of interference and accepting Mr Peard’s admission of the breach of the rule the committee suspends Mr Peard from race riding commencing at the finish of racing on 18 April until the finish of acing on 30 April 2009 (5 days).
