Decision:

The breach is admitted and therefore the charge is proved.

Penalty:

It is ordered that Mr Jones' Riders Licence is suspended from the conclusion of Racing on the 20th of December 2020 up to the conclusion of Racing on the 29th of December 2020. That is 5 National Riding Days being Matamata, Ellerslie,  New Plymouth, Rotorua and New Plymouth.

In addition Mr Jones is fined the sum of $500.00.

Facts:

Following the running of the FULTON FAMILY 1200 an Information was lodged by Stipendiary Steward Mr A Coles against Apprentice Jockey Mr C Jones alleging that Mr Jones as the rider of MORE THE BETTER permitted his mount to shift in near the 1000 metres mark when not clear resulting in crowding to SEAJETZ (Rider D Johnson), SHEEZE A BREEZE (Rider C Dell), BERGAMO FOX (Rider J Riddell) and HE'S THE MAN (Rider O Bosson) which was checked.

Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Jones was present at the Hearing and he acknowledged that he understood the Rule and that he admitted the breach. Mr Jones was assisted by Apprentice Jockey Mentor Mr N G Harris.

Stipendiary Steward Ms V Algar demonstrated the incident using the race films. She identified all horses involved in the incident and showed where near the 1000 metres mark Mr Jones was wide on the track (his horse drew wide at the Barrier) and he was moving forward looking for a position. He was following MIRACLE'S HAPPEN (Rider T Thornton) which had gone to the front and was moving inwards. Mr Jones allowed his horse to move inwards when not sufficiently clear and in doing so he pushed SEAJETZ on to SHEEZE A BREEZE which was in turn pushed inwards on to BERGAMO FOX and it was pushed onto HE'S THE MAN.

Stipendiary Steward Mr Coles said that Mr Jones was barely a length clear when he moved and certainly not the required distance.

Mr Jones and Mr Harris said that they accepted Ms Algar's evidence.

Submissions for Penalty:

Mr Coles said that Mr Jones is an inexperienced Rider but he said that the aggravating feature was that his movement affected 4 horses.

He said that Mr Jones had 2 previous breaches of this Rule in the last 6 months being Counties on the 15th of July 2020 when he received a 2 day suspension and Te Aroha on the 28th of October 2020 when he received a 4 day suspension.

He said that Mr Jones' record was fair and that this incident was in the midrange of seriousness.

Mr Harris said the Mr Jones' horse was following Mrs Thornton's horse inwards and that he was looking to his inside but misjudged the distance. He pointed to Mr Jones' inexperience.

Mr Jones was asked if he would like a deferment of his suspension but he said he would start it at the first opportunity. Senior Stipendiary Steward Mr M Williamson assisted the Committee by confirming that Riders for the meetings up to and including the Gore Racing Club meeting on the 20th of December had been declared and therefore Mr Jones' suspension would begin at the conclusion of Racing on the 20th of December.

The Committee pointed out to Mr Jones the new Penalty Guidelines for Careless Riding that came into force on the 9th of December 2020.

Reasons for Penalty:

The race films clearly show the incident. The Committee accepts that the incident is in the mid range of seriousness and Mr Jones is somewhat fortunate that the affected Jockeys were all very experienced.

Mr Jones has a fair record and he needs to be mindful of the fact that this is his 3rd offence in a period of 5 months.

The prescribed starting point penalty for mid range offending is a $500.00 fine and a 5 day suspension and the Committee advised Mr Jones of this.
