Facts:
Following the running of the DUNSTAN HORSEFEEDS 2100 an Information was lodged by Stipendiary Steward Mr A Coles against Apprentice Jockey Mr M Hashizume alleging that Mr Hashizume as the Rider of VEDO ROSSO used his whip excessively prior to the 100 metres mark.
Rule 638(3)(b)(ii) provides: A Rider shall not strike a horse with a whip in a manner or to an extent which is excessive.
The NZTR Whip Guidelines that came into force on the 7th of October 2020 provide that there is a limitation of 5 strikes with the whip prior to the 100 metres mark.
Mr Hashizume was present and he acknowledged that he understood the Whip Guidelines and that he admitted the breach. Mr Hashizume was assisted by Apprentice Jockey's Mentor Mr N G Harris.
Stipendiary Steward Mr A Dooley demonstrated the incident by use of the race films. He identified Mr Hashizume riding VEDO ROSSO and showed him using the whip prior to the 100 metres mark. He counted 8 strikes with the whip prior to the 100 metres.
Mr Hashizume agreed with the number of strikes.
Mr Harris said that there was not a lot of aggression in the strikes.
Submissions for Penalty:
Mr Coles said that Mr Hashizume had one previous breach of this Rule on the 15th of July 2020 at the Counties Meeting and that involved 8 strikes and he received a $300.00 fine.
Mr Coles referred to the new Whip Penalty Guidelines which came into force on the 9th of December 2020. He said that under those Guidelines this was a second offence and that the starting point penalty is a fine of $500.00.
Mr Hashizume said that he was counting but that he misjudged where the 100 metres mark was.
