Facts:
Following the running of the ANSELL BUILDERS 1300 an Information was lodged by Stipendiary Steward Mr A Coles against Class B Rider Mr M Hashizuma alleging that Mr Hashizuma used his whip excessively prior to the 100 metres when riding Havana Heat.
Mr Hashizuma was present at the Hearing and he acknowledged that he understood the Rule and that he admitted the breach. Mr Hashizuma was assisted by Mr N Harris the Apprentice Jockey's Mentor.
Rule 638(3)(b)(ii) provides: A Rider shall not strike a horse with a whip in a manner or to an extent which is excessive.
Without affecting the generality of Rule 638(3)(b) a rider may be penalised if their whip use is outside of the following guidelines:
Inside the final 600 metres of a race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider's discretion until the winning post is reached.
Stipendiary Steward Mr B Jones demonstrated the incident by use of the race films. He identified Mr Hashizuma riding HAVANA HEAT prior to the 100 metres mark and he counted 8 strikes of the whip.
Mr Hashizuma agreed with the number of strikes and by way of explanation he said he needed to count properly.
Mr Harris said Mr Hashizuma's whip action was tidy and there was not a lot of force in the strikes but he needed to count.
The breach is admitted.
Submissions for Penalty:
Mr Coles referred to 3 warnings since the start of the reset period but Mr Hashizuma did not have any charges under this Rule. He submitted that a fine of $300 was appropriate.
Mr Hashizuma and Mr Harris agreed that the fine was appropriate.

The charge is admitted and the number of strikes is agreed. Under the current JCA Penalty Guidelines Mr Hashizuma is a first offender and therefore is liable to a fine of $300.
