Facts:

Following the running of the TUAKAU COSSIE CLUB 2100 an Information was lodged by Stipendiary Steward Mr A Coles against Class A Jockey Ms S Spratt alleging that Ms SPRATT used the Whip excessively prior to the 100 metres when riding IFFRAAJINATOR.

Rule 638(3)(b)(ii) provides: a rider shall not strike a horse with a whip in a manner or to an extent which is excessive.

Without affecting the generality of Rule 638(3)(b) a rider may be penalised if their whip use is outside the following guidelines:

Inside the final 600 metres of a race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider's discretion until the winning post is reached.

Ms Spratt was present at the Hearing and she acknowledged that she understood the Rule and that she admitted the breach.

Stipendiary Steward Mr B Jones demonstrated the incident by use of the race films. He showed Ms Spratt using the whip on her horse 8 times prior to the 100 metres.

Ms Spratt agreed with the number of strikes.

Submissions for Penalty:

Mr Coles said that apart from a warning in December 2019 this was Ms Spratt's first charge following the reset period. He submitted that the appropriate penalty was a $300 fine. Ms Spratt accepted the level of fine.
