Following race 3 an information pursuant to Rule 871(1)(d) filed by Stipendiary Steward Mr A Coles alleging that Mr Sweeney angled his mount SPEED OF LIGHT outwards in the final straight when not the required distance clear of DANAMORA (T Russell) causing a check to that runner.

Following race 3 an information pursuant to Rule 871(1)(d) filed by Stipendiary Steward Mr A Coles alleging that Mr Sweeney angled his mount SPEED OF LIGHT outwards in the final straight when not the required distance clear of DANAMORA (T Russell) causing a check to that runner.

Mr Sweeney admitted the charge.

As Mr Sweeney admitted the charge the only decision to make was the penalty.

In his submission Mr Coles asked Mr Oatham to demonstrate the films which clearly showed Mr Sweeney's mount move out and take the line of DANAMORA causing interference to her.

Mr Coles also gave Mr Sweeney's record and added that the offence could not be regarded as minor and therefore asked for a suspension.

Mr Sweeney in admitting the charge felt his horse had over-reacted and asked that the Christmas racing be taken into account.

After taking all submissions into account including Mr Sweeney's guilty plea, Mr Coles' comments on the severity of the interference, and the status of the upcoming race meetings we suspend Mr Sweeney from the conclusion of racing on 18 December until the conclusion of racing on 26 December 2004.
