CHARGES:
--Following Race 4 an Information was filed pursuant to Rule 614(2). The Informant Mr Oatham alleged that Mr S Ralph, Trainer of FRENCH DIRHAM, omitted a towel when saddling his horse.
----
FACTS:
--Mr Oatham explained to the Committee that Miss Whiteside, rider of FRENCH DIRHAM, was found to be half a kilo light on weighing in. The reason for this was that Mr Ralph had omitted to add the towel which he had weighed out with when saddling up. Mr Oatham said the ramifications of such a breach could be serious. Mr Ralph, in admitting the breach, said the towel must have been knocked off the rail as he was saddling up. He said he should have been more careful in ensuring all the weigh out gear had been included.

SUBMISSION(s) ON PENALTY:
--Mr Oatham reinforced the possible ramifications that can arise from any gear omissions. However as this was Mr Ralph’s first charge under this rule and he had admitted the breach he submitted a fine of $200 - $250 would be appropriate.

Mr Ralph had nothing further to say regarding penalty.

REASON(s):
--The Committee considered all evidence and submissions before imposing a penalty. The Committee reminded Mr Ralph of his obligations as a Trainer under this rule. Because Mr Ralph admitted the breach, had been fully co-operative with the Stewards and that this was his first charge under this rule we believe a fine is an appropriate penalty.

PENALTY:
--Accordingly, taking all the above facts into account we impose a fine of $250.
