As Mr Jones admitted the breach the Committee found the charge proved.

Penalty:

Accordingly, Mr Jones had his Licence to ride in races suspended for a period of 5 days commencing after racing on 14th March 2021 and concluding after racing on 22nd March 2021. In addition, we impose a $250 fine.

Not included in the penalty were Ellerslie 13th March and Gore 14th March as declaration of riders had closed.

Facts:

This charge arises from the running of Race 6, the Dunstan Speedfeed Maiden 1200. Stipendiary Steward, Mr Coles filed an Information pursuant to Rule 638(1)(d) alleging the Rider of “SO CHARMING” (C Jones), ”allowed his mount to shift in when insufficiently clear of “COPPER EXPRESS”, which was checked passing the 950 metres”.

Mr Jones acknowledged that he understood the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Using the available race films Senior Stipendiary Steward, Mr Williamson demonstrated the incident and identified the horses and riders concerned; SO CHARMING (C Jones) and COPPER EXPRESS (E McCall).

Mr Williamson said that Mr Jones began from a wide barrier and angled his mount across to the rail endeavouring to keep clear of the horses to his inside. He submitted Mr Jones allows his mount to shift into a point where he doesn’t provide enough room for COPPER EXPRESS who was improving to his inside. He said that COPPER EXPRESS got “squeezed” and then reacted badly racing out and across the heels of SO CHARMING. Mr Williamson estimated that SO CHARMING was only ¾-1 length clear at the time of the interference, but added that if Mr Jones had stayed a foot wider the interference may not have occurred.

In response, Mr Jones agreed with the interpretation of the Stewards. He added that Miss McCall called out to him as her horse was checked.

Mr Harris said that he had spoken to Miss McCall after the incident and thought that a Senior Rider probably would have taken a hold of their mount, however he confirmed that Miss McCall was entitled to be in the position that she was at the time of the interference.

Submissions for Penalty:

Mr Coles produced Mr Jones riding record which indicated 4 previous breaches under the careless riding Rule in the last 12 months.
Mr Coles said Stewards assessed the level of carelessness to be in the low range.
Mr Jones had nothing to add in relation to penalty submissions and did not seek a deferment to any proposed suspension.

Reasons for Penalty:

After considering the submissions and reviewing the Race film the Committee determined Mr Jones’ carelessness to be in the low range and adopted a 4-day (suspension) and $250 (fine) as the starting point.

The available films established that Mr Jones allowed his mount to shift in when no more than 1 length clear of COPPER EXPRESS causing it to be tightened. The Committee assessed the breach to be at the low end. Mr Jones' shift inwards was performed with care until the last two strides where he tightened COPPER EXPRESS which had improved to his inside.

The Committee raised some concern with Mr Jones regarding his riding record, having 4 previous breaches in 167 rides. The Committee evaluated Mr Jones record as being below average and applied a 1 day uplift from the starting point.
