Penalty:
The Committee granted Mr Calder a deferment to his suspension pursuant to Rule 1106(2). Accordingly, his Licence to ride in races is suspended for a period of 4 days commencing after racing on 20th March 2021 and concluding after racing on 26th March 2021. In addition, we impose a $250 fine.
Facts:
This charge arises from the running of race 5, the Haunui Farm Stallions Maiden 1200. Stipendiary Steward, Mr Coles filed an Information pursuant to Rule 638(1)(d) alleging the Rider of “TEMPTING HEART” (A Calder), ”allowed his mount to shift in when insufficiently clear of JAMIESON'S TIPPLE, which was checked passing the 950 metres”.
Mr Calder acknowledged that he understood the Rule and confirmed his admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Using the available race films Senior Stipendiary Steward, Mr Williamson demonstrated the incident and identified the horses and riders concerned; TEMPTING HEART (A Calder) and JAMIESON’S TIPPLE (Craig Grylls).
Mr Williamson said that approaching the 950m Mr Calder allows his horse to shift into the line of JAMIESON’S TIPPLE which had to check. He went on to say that Stewards did acknowledge that it was a difficult bend (particularly with the rail out 7m), however Mr Calder had a duty of care to allow sufficient room for JAMIESON'S TIPPLE and in not allowing the room had made a small error. Mr Williamson estimated that TEMPTING HEART was only 1 length clear at the time of the interference.
In response, Mr Calder stated that he made an error of judgement when shifting in towards the running rail on the point of the corner as opposed to going around the corner. He said that on two occasions he pulled on the left rein in an attempt to prevent his mount from getting into the line of JAMIESON’S TIPPLE however acknowledged that this may have occurred a stride too late.
Submissions for Penalty:
Mr Coles produced Mr Calder’s riding record which indicated 3 previous breaches under the careless riding Rule in the last 12 months.
Mr Coles said Stewards assessed the level of carelessness to be in the low range.
Mr Calder had nothing to add in relation to penalty submissions and sought a deferment to any proposed suspension until after racing on 20th March 2021.

After considering the submissions and reviewing the race film the Committee determined Mr Calder’s carelessness to be in the low range and adopted a 4-day (suspension) and $250 (fine) as the starting point.
The available films clearly established that Mr Calder allowed his mount to shift in when no more than 1 length clear of JAMIESONS TIPPLE causing it to be checked. The Committee assessed the breach to be at a low level. The inward movement was gradual and only one horse was affected.
Mr Calder’s riding record was assessed as being a neutral factor as his 3 previous breaches had occurred in more than 320 rides.
