Charge:
Following race 4 an information was filed pursuant to Rule 638(3)(b). The informant Mr Coles alleged that Mr Cameron used the whip aboard GET ON IT in a manner that was excessive.
Facts:
Mr Coles demonstrated the incident using the video films and pointed out to the committee Mr Cameron riding GET ON IT striking his mount 18 times prior to the 200 metres. Mr Coles submitted that Mr Cameron had failed to give his mount the required respite.
Mr Cameron in admitting the breach said it is a long straight and he misjudged it.
Submissions for Penalty:
Mr Coles said Mr Cameron had a clear record under this rule and submitted a fine of $150 would be appropriate.
Mr Cameron when asked for submissions on penalty had nothing to say.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions presented. The mitigating factor is Mr Cameron's admission of the breach. The Chairman referred to the JCA listing of penalties which showed Mr Cameron had been charged with excessive whip use on 4th June 2011, we assess the offending to be mid range. Mr Cameron is a very busy rider so therefore his overall record is good, however any further breach of this rule will result in an increased fine.
