As Mr Cropp admitted the breach we find the charge proved.
Penalty:
We grant Mr Cropp's submission to seek a deferment to his suspension as per rule 1106(2).
Accordingly we impose a suspension on Mr Cropp which will commence after racing on 19th of February 2012 and to conclude after racing on 26th February 2012 (4 days).
Charge:
Following race 3 an information was filed pursuant to Rule 638(1)(d). The informant Mr Coles alleged that near the 1000 metres Mr M Cropp (ISLINGTON BAY) allowed his mount to shift in when not clear of KAHALA (J McDonald) which was crowded and checked.
Facts:
Mr Robinson demonstrated the incident using the head on and side on films. He pointed out to the committee that Mr Cropp was racing in a 4 wide position near the 1,000 metre mark when he angles his mount into a position of 1 off the rail. He said Mr Cropp was a bare length clear when moving in, this resulted in KAHALA being checked.
Mr Cropp advised the committee he was happy to hear the charge without representation. The Stipendiary Stewards had discussed this with Mr Cropp prior to the hearing.
Mr Cropp when asked to give evidence on the incident had nothing to say.
Submissions for Penalty:
Mr Coles produced Mr Cropp's record which showed he had no previous suspension in the last 12 months.
He said Mr Cropp had a very good record and submitted the degree of carelessness was low to mid range and a suspension was an appropriate penalty. Mr Coles advised the Committee that Mr Cropp rode only in the North Island and confirmed he would be attending the upcoming Wairoa 2 day race meeting.
Mr Cropp submitted that he had firm commitments up to and including 19th February 2012 and therefore seeked a deferment to his suspension. He confirmed to the committee he rode in the North Island.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions presented. The mitigating factors are Mr Cropp's admission of the breach, his excellent riding record. However this has to be balanced against the level of carelessness which we assess as low to mid range. We accept that Mr Cropp is a North Island rider.
