As Mr Kasim admitted the breach we find the charge proved.
Penalty:
Accordingly we impose a suspension on Mr Kasim which will commence after racing on 12th of February 2012 and to conclude after racing on 18th February 2012 (4 days).
Charge:
Following race 3 an information was filed pursuant to Rule 638(1)(d).The informant Mr Coles
alleged that near the 450 metres H Kasim (MA BELLA AMI) allowed his mount to shift in dictating KEEP THINKING (M Hills) in onto BELLE DE JEU (M Cameron)which was checked.
Facts:
Mr Coles demonstrated the incident using the head on and side on films. He pointed out to the committee that Mr Kasim when racing in a 3 wide position at the 400 metres he allowed his mount to shift in to a 2 wide position. He said Mr Kasim was only ¾ length clear when shifting ground, this resulted in BELLE DE JEU being checked.
Mr Kasim said his mount was racing in a 3 wide position and conceded to the committee he layed in and placed pressure onto 2 runners on his inside.
Mr Clarken said Mr Kasim misjudged his inward movement stating it was not intentional.
Submissions for Penalty:
Mr Coles produced Mr Kasim's record which showed 1 previous suspension in the last 12 months. He said Mr Kasim had a very good record and submitted the degree of carelessness was low to mid range and a suspension was an appropriate penalty.
Mr Kasim, when asked for submissions on penalty, was unable to advise the committee with his riding commitments in the next 7 days. The Chairman encouraged Mr Kasim to contact his riding agent to determine his commitments. The hearing was adjourned for 5 minutes to allow this to happen.
On his return Mr Kasim informed the committee that he had no commitments in the next 7 days. Mr Kasim conceded that he rides only in the North Island.
Mr Clarken accepted that Mr Kasim had no commitments in the next 7 days and submitted he would like the suspension to start immediately. He accepted that Mr Kasim rides in the North Island.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions presented. The mitigating factors are Mr Kasim's admission of the breach, his very good record. However this has to be balanced against the level of carelessness which we assess as low to mid range. We accept that Mr Kasim is a North Island rider.
