Following Race 1 an Information was filed pursuant to Rule 876 (1) when it was alleged by the Informant, Mr. F. Leahy ? Trainer of the 2nd horse, Scruple, that the horse suffered interference inside the final 100 metres.
DECISION AND REASONS:
--Following Race 1 an Information was filed pursuant to Rule 876 (1) when it was alleged by the Informant, Mr. F. Leahy ? Trainer of the second horse, Scruple, that the horse suffered interference inside the final 100 metres.
--All connections were advised of the protest.
--Present at the enquiry were: Mr. F. Leahy, Trainer of Scruple and his rider, J. Gillies. Mr. T. Cole, trainer of Mud ?N? Rum and his rider M. Campbell.
--Mr. Leahy in his evidence and in demonstrating the video film said that Mud ?N? Rum who was on the inside of Scruple veered out making contact causing the rider J. Gillies to check and lose a stride. Mr. Leahy also said that at no stage did Mr. Campbell stop riding or take evasive action.
--Mr. Gillies, rider of Scruple, said he was hit by Mud ?N" Rum when it ran out which he believed cost him the race. He also said Mr. Campbell did not stop riding.
--Mr. T. Cole, trainer of Mud ?N? Rum, agreed that although his horse did move in it was right on the line and his horse was only following the natural curve of the running rail. He also said Mr. Campbell did not stop riding.
--Mr. A. Cole, stipendary steward, when asked for his assessment said that the winner had come from behind the second horse and had made up a lot of ground to do so. He also said the incident was barely two strides off the post on the angle.
--DECISION:
--The Committee carefully considered all evidence and repeated viewing the video films.
--We are satisfied that the second horse, Scruple, did suffer interference from the 1st horse Mud ?N? Rum when that horse moved out into its line approximately 2-3 strides from the post.
--However, in reaching a fair and correct decision we are not satisfied that the chances of Scruple finishing in a better place were affected. This is because the outward movement of Mud ?N? Rum was only 2 ? 3 strides off the post and he had come from well behind Scruple before the interference.
--Accordingly the protest is dismissed and the judges placing's stand.
