Facts:
Following the running of the MARTIN " SMOKEY" MORGAN MEMORIAL, an Information was lodged by Senior Stipendiary Steward, Mr M Williamson against Class B rider, Ms T Miles alleging that Ms Miles allowed her mount TOODALOO to shift in near the 850 metres mark when not sufficiently clear of ASTON PARK (Rider S Spratt) which was checked.
Rule 638(1)(d) provides : A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Ms Miles was present at the Hearing and advised the Committee that she understood the Rule and that she admitted the breach.
Ms Miles was assisted by Apprentice Mentor Mr NG Harris.
Stipendiary Steward, Mr B Jones demonstrated the incident by use of the race films and showed where passing the 850 metres mark Ms Miles allowed her horse to move in and into the line of ASTON PARK which caused its rider to take hold. He said that Ms Miles was barely a length clear and not the required distance.
Ms Miles accepted the film evidence and said that it was unfortunate that the incident had happened.
Mr Harris said that when she was going forward Ms Miles misjudged the shift in. He said that he tells apprentices that when they are going forward they need to leave the leader alone.
Submissions for Penalty:
Mr Williamson submitted that this was a small mistake on the part of Ms Miles and in terms of seriousness it was at the very low end.
He said that the Committee should take into account that Ms Miles is a young rider of limited experience ( she has had 84 rides ) and she has admitted the breach. He also said that she had a very good record and not even a warning.
Mr Harris asked the Committee to take into account Ms Miles very good record and the fact that it was a simple misjudgement on her part.
Reasons for Penalty:
The Committee has reviewed the race films and taken into account the submissions of the parties. The Committee views the incident at the very low level of seriousness albeit that Ms Spratt had to take hold of her horse.
We give Ms Miles credit for her admission of the breach , her very good record and the fact that she is an inexperienced Class B rider.
The JCA Penalty Guidelines provide for a starting point penalty for low range careless riding of 6 National Riding days. We have given Ms Miles a 1 day reduction because of the mitigating factors set out above.
Ms Miles has advised us that her suspension can begin immediately. We have pointed out to her that any suspension will not take into account the Ruakaka meeting on the 12th of August for which Riders have already been declared.
