Following race 2 a protest was lodged by Mr B Peterson, trainer of the third placed horse SPURATHOUGHTFORME (number 6, ridden by Cory Parish).

DECISION & REASON:
--Following race 2 a protest was lodged by Mr B Peterson, trainer of the third placed horse SPURATHOUGHTFORME (number 6, ridden by Cory Parish). He alleged that THE FRED FACTOR (number 1) or its rider placed first by the Judge interfered with the chances of SPURATHOUGHTFORME placed third by the Judge.
--The official margin between second and third was one length.
--All connections were notified of the protest hearing.
--The information was filed with the Registrar with the Registrar within the time prescribed under Rule 917 and 1107(2).
--Present during the hearing were Brad Peterson and Cory Parish, the trainer and rider of SPURATHOUGHTFORME. Richard Collett for S Hale/N Collett for THE FRED FACTOR.
--Mr Peterson said there were two incidents of interference at approximately the 300 metres and the 200 metre mark. He demonstrated the incidents on the race videos (head-on). He contended that his horse had been inconvenienced in the heavy ground and would have run second taking into account the one length margin between second and third. Mr C Parish confirmed Mr Peterson's assertions.
--Mr Collett said that at no time did jockey parish stop riding or restrain his mount. He emphasized the margin of one length and the interference was minor.
--Mr Oatham, Stipendiary Steward, gave an assessment of the alleged incident. He said there were two outward movements but jockey Parish did not stop riding. He emphasized the margin of one length. He also mentioned that the winner was pulling away at the finish. He submitted that the placings should stand.
--Rule 876(1) requires us to ask first whether interference occurred, and then if so, whether that interference has cost the horse interfered with a chance of finishing in a better position.
--We are satisfied having carefully viewed and reviewed the films, and listening to the evidence that slight interference occurred.
--CONCLUSION:
--We do not believe the chances of SPURATHOUGHTFORME finishing in a better position were affected. Accordingly, the protest is dismissed and the Judge's placings stand.
