As Mr Innes admitted the breach the Committee found the charge proved.
Penalty:
The Committee granted Mr Innes a deferment to his suspension pursuant to Rule 1106(2). Accordingly, his license to ride in races is suspended for a period of 4 days commencing after racing on the 17th of April 2021 and concluding after racing on 24th April 2021. In addition, we impose a $500 fine.
Facts:
This charge arises from the running of Race 5, the Dunstan Horse feeds 1400. Stipendiary Steward, Mr Coles filed an Information pursuant to Rule 638(1)(d) alleging the Rider of LEAVE IT TO ME (L Innes),” allowed his mount to shift in near the 400 metres when insufficiently clear of COLIN OSCOPY and FRANCESCA with COLIN OSCOPY being checked”.
Mr Innes acknowledged he understood the Rule and confirmed his admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Using the available race films Senior Stipendiary Steward, M Williamson demonstrated the incident and identified the horses and Riders concerned; LEAVE IT TO ME (L Innes), COLIN OSCOPY (S Collet) and FRANCESCA (S Weatherley).
Mr Williamson said that entering the straight LEAVE IT TO ME was racing in a loose 4 wide position to the outer of COLIN OSCOPY with FRANCESCA being to COLIN OSCOPY’S inner. He said that at this point Mr Innes allowed his mount to shift in crowding both COLIN OSCOPY and FRANCESCA with the Rider of COLIN OSCOPY having to take a hold before being checked. Mr Williamson estimated the margin at the time of the shift to be between ½ to ¾ length. He also added that Francesca did go on to win the race.
Mr Innes, said the breach was pretty clear and he had drifted inwards. He also added that his horse was green and may have been distracted by the tyre marks on the track.
Submissions for Penalty:
Mr Coles produced Mr Innes' riding record which indicated 2 previous breaches under the careless riding Rule in the last 12 months. These breaches had occurred over approximately 231 rides, with today’s breach being his 3rd charge.
Mr Coles said Stewards assessed the level of carelessness to be in the mid range. He added that Mr Innes had been very forthright and admitted the breach at the first opportunity and should be given credit for that.
Mr Innes confirmed he had commitments for Saturday the 17th of April, and asked for any suspension to start after that date. He asked if the Committee could consider a 3 day suspension and an increased fine to enable him to ride at Ellerslie on the 24th of April.
Reasons for Penalty:
The Committee viewed the head-on, side-on and back-on films which established that Mr Innes allowed his mount to shift inwards when challenging for the race lead. The Committee identified, that just prior to the interference Mr Innes’ mount was no more than ¾ clear of the runners to his inside.
After considering the submissions and reviewing the race film the Committee determined Mr Innes’ carelessness to be in the mid-range and adopted a 5-day (suspension) and $500 (fine) as the starting point.
Mr Innes' riding record was assessed as being a neutral factor as his 3 breaches (this being his 3rd) had occurred over 231 rides, combining his record and admission of the breach, the Committee afforded Mr Innes a 1 day discount on penalty.
The Committee gave consideration to Mr Innes’ request for a reduced suspension and increased fine, however after consideration determined that this wasn’t consistent with previous offences of a similar nature.
