As the breach was admitted we find the charge proven.

Penalty:

After taking all the above into account we impose a fine of $300.

Charge:

Following race 1 an information was filed pursuant to rule 638(3)(b).  The informant Mr Coles alleged that Mr C Leveque had used his whip excessively on his mount ALDERNEY.

Facts:

Mr Coles demonstrated the video films and pointed out to the committee Mr Leveque striking his mount ALDERNEY 14 to 15 times before the 200 metres.  Mr Coles submitted that Mr Leveque did not give his mount the required respite as set out in the whip guidelines.
Mr Leveque said he realised too late that he had given his mount too many strikes.

Submissions for Penalty:

Mr Coles said Mr Leveque had incurred 1 charge under this rule but that was in August 2010 when he was fined $350.  He submitted a fine of a similar amount would be appropriate.
Mr Leveque had nothing to add regarding penalty.

Reasons for Penalty:

The committee carefully considered all submissions and evidence.  In mitigation Mr Leveque admitted the breach, his record under this rule was good and he was using the whip when his mount was responding and going on to win the race,  However, he did strike his mount a number of times well in excess of the guidelines.
