Facts:

Following race 1 an information was filed pursuant to rule 638(3)(b).  The informant, Mr Coles, alleged that Mr C Dell used the whip excessively on his mount GOLD MESSAGE.

Submissions for Decision:

Mr Coles demonstrated the video films and pointed out to the committee Mr Dell, riding GOLD MESSAGE, strike his mount approximately 20 times before the 200 metres.  Mr Coles submitted this was well outside the whip guidelines of 6 strikes and 6 strides respite.
Mr Dell, in admitting the breach, realised on viewing the films that he had struck his horse an excessive number of times.

Submissions for Penalty:

Mr Coles said this was Mr Dell's first charge and this was his first season of riding as a professional.  he submitted a fine at the low end would be appropriate.
Mr Dell had nothing to say regarding penalty.

Reasons for Penalty:

The committee carefully considered all evidence and submissions. Mitigating factors include Mr Dell's admission of the breach and that this was his first charge.  However, he was clearly well in excess of the whip guidelines.
