Decision:

The committee being satisfied that Mill Duckie was denied a fair start ruled the horse a non starter and be scratched from the race.  Payment of dividends on the Judges placings was authorised.

Facts:

Stipendiary steward Mr A Coles lodged an information requesting a ruling as to whether Mill Duckie was denied a fair start in race 8 because of a starting gate malfunction. 

 The Rule reads

' If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings  was prevented in taking an effective part in a Race owing to the  mechanical failure of starting stalls ........, the Judicial Committee may declare such horse to be a non starter' 

Stipendiary Steward Mr J Oatham referred to head and side on footage and indicated where Mill Duckie had to force its way out after the failure of its barrier gate to open with those of other starters.  As a result the horse had a delayed start took no effective part in the race and finished last.

Following the race the Stewards had been approached by the Jockey Miss T Collett and the starter, Mr T Harrision who both confirmed that the barrier gate was slow to open.   

Mr Kenny, representing  the connections of Mill Duckie agreed with the Stipendiary Stewards' submissions that the horse be declared a non starter.

Mr Coles confirmed that the Stipendiary Stewards were of the opinion that Mill Duckie had clearly been denied a fair start by the slow activation of the barrier gate and because of this requested the horse be declared a non starter.

Reasons for Decision:

Video footage clearly showed the barrier gate impeded Mill Duckie at the start and thus denied the horse a fair start.
