Following the running of Race 7, Cheviot Licensing Trust “Cheviot Cup”, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Driver, Mr M P Jones, alleging a breach of Rule 869 (2) (a) in that Mr Jones “when driving SHESACHRISTIAN in the run home used his whip excessively”.



DECISION AND REASONS:

Following the running of Race 7, Cheviot Licensing Trust “Cheviot Cup”, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Driver, Mr M P Jones, alleging a breach of Rule 869 (2) (a) in that Mr Jones “when driving SHESACHRISTIAN in the run home used his whip excessively”.

Mr Jones had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach of the Rule and, secondly, that he did not wish to be present at the hearing of the information. The charge was found proved accordingly.

Rule 869 provides as follows:

--

(2)     No horseman shall during any race:

--

         (a)   use his whip in an unnecessary, excessive or improper manner.

--

Mr Escott showed a video replay of the final 200-300 metres of the Race. He pointed out Mr Jones on SHESACHRISTIAN trailing the leader entering the home straight. He alleged that Mr Jones used his whip between 17 and 19 times in the home straight. After the initial two strikes, the remaining strikes were “on drum beat” and Mr Jones “never let up” over the final stages, Mr Escott said.

Mr Escott informed the Committee that Mr Jones had a previous breach of the Rule on 4.4.08, nearly 12 months ago, and was fined $250 on that occasion. Mr Escott said that, because of Mr Jones’ guilty plea, he was recommending a fine of $250.

The Committee, in determining penalty, had regard to Mr Jones’ admission of the breach and the previous breach in April 2008.

Mr Jones was fined the sum of $250.
