DECISION AND REASONS:

--

This matter was heard at the Ashburton Trotting Club’s meeting at Ashburton on 10 March 2010.

--

Following the running of Race 4, the Cheviot Businesses Mobile Pace, an information was filed by Stipendiary Steward Mrs K. R. Williams against Mr K. V. Hadfield, the driver of “Ruby Ann” (10), alleging a breach of Rule 869(3)(b).  The charge was that Mr Hadfield drove carelessly on entering the final straight when allowing his horse to strike the sulky wheel of “Numero Uno”, causing his horse to pace roughly and for “Numero Uno” to suffer a punctured sulky tyre.

--

Mr Hadfield had been spoken to by Mrs Williams on the phone, and he had advised her that he admitted this breach, and that he did not want to attend the hearing.  The Chairman also spoke to Mr Hadfield on the phone and he confirmed that he admitted the breach and that, after discussions with Mrs Williams, he had accepted a two day suspension as being an appropriate penalty.

--

Taking all the above matters into account we have agreed that an appropriate penalty in this case is a two day suspension.  Accordingly Mr Hadfield’s Open Horseman’s Licence is suspended from after the completion of racing on 7 March 2010, until after the completion of racing on 19 March 2010.  This suspension includes race meetings at Addington on 16 and 19 March 2010.
