Following the running of Race 2, the Magpies Rest Café “Vivace Coffee” Mobile Pace, an information was filed by Stipendiary Steward Mrs K. R. Williams against Mr S. J. Thompson, the driver of “Mollie Mach” (10), alleging that Mr Thompson had committed a breach of Rule 869(4) in that he attempted to shift outwards with 650 metres to race when not in a position to do so causing his own horse to gallop and interference to Forward Pass and surrounding runners.

DECISION AND REASONS:

Following the running of Race 2, the Magpies Rest Café “Vivace Coffee” Mobile Pace, an information was filed by Stipendiary Steward Mrs K. R. Williams against Mr S. J. Thompson, the driver of “Mollie Mach” (10), alleging that Mr Thompson had committed a breach of Rule 869(4) in that he attempted to shift outwards with 650 metres to race when not in a position to do so causing his own horse to gallop and interference to Forward Pass and surrounding runners.

Mr Thompson had indicated on the information that he admitted this breach of the Rules and that he did not wish to attend the hearing.

Mrs Williams gave evidence and used video coverage to illustrate this incident.

--

Mrs Williams advised that Mr Thompson had no previous relevant convictions, and recommended a two day suspension, which Mr Thompson had preferred to a fine.  We were satisfied that the suspension recommended was appropriate in this case.

--

Accordingly Mr Thompson’s Open Horseman’s Licence was suspended from after the completion of racing on 7 March 2010 until after the completion of racing on 11 March 2010, this being a two day suspension.
