Facts:
Following the running of Race 7, the “Donegal House” The Little Irish Pub Near Kaikoura Mobile Pace, an information Instigating a Protest was filed by Stipendiary Steward Mr N. M. Ydgren alleging a breach of Rule 869(8) by “Ten Diamonds” (12), driven by Mr R. T. May. The Judge’s placings were as follows.
1st – Highview Chasue (1)
2nd – Bettor Move It (3)
3rd – Ten Diamonds (12)
4th – Together Again (4)
5th – Forever Arma (5)
6th – The Slipper (2)
The Information reads as follows.
“This is a protest by horse number (8) placed 10th by the Judge against horse number (12) placed 3rd by the Judge on the grounds that with 200m remaining, Ten Diamonds shifted outwards checking 8 and 11.”
Rule 869(8) provides as follows.
(8) The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.”
Submissions for Decision:
Mr J. F. Curtin attended the hearing and represented the connection of “Flyover” (8). Mr L. J. Hanrahan, the part owner of “Ten Diamonds” (12), represented the interests of that horse.
Stipendiary Steward Mr Ydgren gave evidence and used video coverage to show that with about 200 metres to run “Ten Diamonds” moved out sharply interfering with “Flyover”, which lost its chance in the race.
Mr Hanrahan advised that this protest was not contested.
Reasons for Decision:
As the protest was not contested “Ten Diamonds” was relegated from 3rd to 10th place behind “Flyover.
