As Mr Allen has admitted the breach, we find the breach proved.
Penalty:
Mr Allen is suspended from driving from the end of the Roxburgh meeting on 4 January up to and including 10 January. This includes the meeting at Timaru on January 5, at which Mr Allen said he intended to drive one of his horses, and two Otago/Southland days.
Facts:
Mr Tidmarsh, Stipendiary Steward, alleged that Mr Allen in race 2, the DUNCAN AGRICULTURAL/OMAKAU AUTO CENTRE MOBILE TROT, drove carelessly near the 1500 metres when tightening HORSE OF COURSE causing that runner to break.
Mr Tidmarsh demonstrated on the videos that HORSE OF COURSE was established in a run one back on the pylons to the inside of STILL EYRE, driven by Mr Allen. As the field entered the bend Mr Allen did not give sufficient room to HORSE OF COURSE and that horse broke and galloped for some 110 metres.
Mr Allen acknowledged he had placed pressure on HORSE OF COURSE. He said his horse had laid in on the bend and had been affected by the leading horse, which had drifted out a little.
Submissions for Penalty:
Mr Tidmarsh produced the respondent’s record which evidenced this was only his second drive this season and he had 5 drives last season.
Mr Tidmarsh said it was not a sharp shift but Mr Allen had checked another runner and his horse had been relegated as a result. He submitted a 3-day suspension was appropriate.
Mr Allen stated he would accept a 3-day suspension as being a fair penalty.
Reasons for Penalty:
We view the breach as at the top end of mid range. Although Mr Allen has not shifted in a great deal, it was sufficient to place pressure on HORSE OF COURSE, with that horse breaking when it came into contact with pylons. The starting point in the JCA Penalty Guide, where there has been a relegation, is 3 days. The members of the public that placed bets on HORSE OF COURSE and STILL EYRE have been affected by the respondent’s actions. A one-day increase in the starting point is appropriate.
Mr Allen’s record is good, and he has admitted the breach. We afford a one-day discount. That returns us to our starting point.
