Facts:
At the conclusion of Race 8, the BECKER’S TRANSPORT LTD FFA MOBILE TROT, an information was lodged by Mr Allison under 870(4)(a) alleging COOL COBBER, which was promoted to 5th as a result of an earlier protest, was in its incorrect gait in excess of 50 metres over the final stages.
Placings after the earlier protest were:
1st - 8 SPRINGBANK SAM
2nd - 5 JAG’S INVASION
3rd - 6 MONNAY
4th - 2 ALLEY WAY
5th - 10 COOL COBBER
6th - 1 SPIN DOCTOR
Rule 870(4) provides:
Any horse which breaks from its gait in any race and (a) which fails to promptly regain its proper gait … may (in addition to any other penalty imposed pursuant to Rule 1003 hereof) subject to the provisions of the Breaking Horse Regulations made by the Board, be placed by the Judicial Committee immediately after any other horse in respect of which any advantage may have been gained.

Mr R Swain, the driver of COOL COBBER indicated on the information that he did not contest the protest.
Reasons for Decision:
The Committee was satisfied that COOL COBBER galloped in excess of 50 metres over the final stages. In these circumstances the horse is disqualified.
