Stipendiary Steward Mr P T Knowles alleged that prior to the start MACARTHUR PARK broke checking LAST LINK, which broke, losing considerable ground.

Stipendiary Steward Mr P T Knowles alleged that prior to the start MACARTHUR PARK broke checking LAST LINK, which broke, losing considerable ground.

Video evidence showed no. 2 TURBO PAT, driven by M Jones, galloping for a considerable distance behind the arm. Just short of the starting line TURBO PAT propped and MACARTHUR PARK broke. Mr Shirley moved his horse LAST LINK down to the rail area and trotted for 3 or 4 strides and then broke.

Mr Shirley initially thought he might have clipped Mr Barron's wheel but on reflection was definitely unsure of this and said that in the circumstances Mr Barron had done a good job in giving him room.

Mr Barron said he felt Mr Shirley's horse had broken free of interference and there was definitely no contact. When asked, he said that he had not received a puncture in the race.

Mr White said he had later found a flat tyre on the float but had not been aware of it after the race.

(Starter) Mr Ward said no one called out. He felt Mr Shirley's horse was not interfered with. He was sure MACARTHUR PARK had not checked LAST LINK but may at worst have given it a fright. He felt LAST LINK broke free of interference and did not call a false start.

In reply to a question Mr Shirley said he had to take hold of LAST LINK to clear the area but trotted for 3 or 4 strides before breaking.

DECISION

--

I find there is sufficient doubt as to what caused LAST LINK to break and that based on both Mr Barron's and Mr Shirley's evidence in particular I dismiss the protest and leave the placings as per the judge's call.
