Decision: Stipendiary Steward Mr P T Knowles alleged that “J R Dunn drove carelessly when shifting ground outwards coming into contact with BORN AGAIN COURAGE, driven by K L Barclay, with resulting check to MEGLEA and REINBOW JACCKA”.

Video evidence was shown several times and confirmed that Mr Dunn had come out in two stages and quite sharply on the second movement.

Mrs Barclay said Mr Dunn had every right to come out but unfortunately made too sharp a movement.  The video showed clearly that Mrs Barclay’s horse’s leg struck Mr Dunn’s wheel.

Mr Dunn agreed he had come out quickly but claimed he had corrected the movement as quickly as possible and at all times had both reins in both hands.  He said the interference was accidental and no intention was involved, and stressed his horse was very green.

After hearing all the evidence and viewing the video on several occasions I uphold the charge.  Mr Knowles considered it to be a medium level incident.

PENALTY

Submissions as to penalty were heard.  Mr Dunn had recently been fined $250 for driving in a manner likely to cause interference.  This was his only related fine in the current 12 months.

Mr Knowles asked for a $500 fine or a 3 day suspension.  Mr Dunn thought this was excessive and suggested a $300 fine.

Taking everything into account – Mr Dunn’s recent fine and also his lack of intention in the interference - I fine him $400.
