Stipendiary Steward Mr P T Knowles alleged that "B W Ward failed to call a false start when LAST LINK suffered interference by MACARTHUR PARK prior to the start".

Mr Knowles and Mr Ward agreed that evidence given in the protest heard earlier be taken as read.

Mr Knowles stated that every horse is entitled to a clear run to the start and that LAST LINK should not have had to change ground, which eventually caused him to break. He felt Mr Ward should have called a false start and this would have been fully agreed to by the Stipendiary Stewards.

Mr Ward said Mr Shirley's horse LAST LINK was on the steel and pulling. Horse no. 2 had broken free of interference and when MACARTHUR PARK had broken Mr Shirley's horse had trotted after having changed ground. He said Mr Shirley did not call out as he usually does if need be. He said you get to know your drivers and what they do. He said he felt it was definitely a legitimate start.

Mr Knowles on one hand believes changing direction was the cause of LAST LINK breaking whereas on the other hand Mr Ward contends that LAST LINK was trotting correctly for 3 or 4 strides after the change of direction and this was not the cause of the horse breaking.

Returning to the evidence given in the protest, I was most taken with Mr Barron's evidence when he said Mr Shirley's horse had broken free of interference and I find that it is by no means certain that the change of direction of LAST LINK may have caused it to break but then again it may have. I find that while there is some definite merit in the charge there is a large element of doubt and on the balance of probabilities I find it prudent to dismiss it.
