Mr Laking admitted a breach of rule 520(4)(c) in that he failed to make the contract weight of 55.5 kg for CHRISTEL BIRGITTA in Race 4. The charge is therefore proved.
----We note that this is Mr Laking's second such offence within a week, and that he has reoffended on this occasion despite having received a stern warning that a more serious penalty than the lenient fine imposed on the earlier occasion would be the likely outcome.
----We acknowledge Mr Laking's efforts today, in particular his co-operation with the stipendiary stewards and during this hearing, and his ready admission of the breach. We have heard submissions from Mr Davidson and Mr Laking in respect of penalty. Mr Davidson suggested either a substantial fine or a suspension, and Mr Laking indicated his preference for a suspension.
----Following our consideration of the matter, we have concluded that Mr Laking should have his licence suspended for 3 South Island racedays; that is from the conclusion of racing at Waikouaiti on 1 January 2008 until the conclusion of racing on 9 January 2008.
----In determining the penalty, we have taken into account the proviso, as agreed by Mr Laking and the stipendiary stewards, that Mr Laking does not accept rides at a weight of less than 56 kg without the specific approval of Mr Ching.
