The Committee finds the charge proved.

Penalty:

Mr Walters is suspended from the conclusion of racing at the Greymouth meeting on January 4th, up to and including January 15th. (3 South Island days).

Facts:

Following the running of race 8 the COPPER CAFÉ & BAR/WHITE ROBE LODGE CLARE MEMORIAL GOLD CUP HDCP, Stipendiary Steward, Mr Davidson lodged an information alleging Mr Walters allowed his mount KING PRAWN to shift outwards checking ALPINE HEIGHTS over the concluding stages.

Mr Walters did not admit the charge and appeared at the hearing.

Submissions for Decision:

Mr Davidson said King Prawn shifted outwards and placed Mr Cropp’s mount in restricted room between ALPINE HEIGHTS (inner) and DARCI COUP (outer). He said Mr Walters did correct his mount but only after Mr Cropp had yelled out to him.

In evidence Mr Cropp stated he got up to the hind-quarters of KING PRAWN before he was forced to check his mount as he was getting squeezed up between runners. He said he called out the moment he took a hold of his horse.

Mr Walters stated in his view Mr Cropp should have given a call earlier. He said he was focusing on the nose of the outside runner (DARCI COUP) and was not aware there was a horse improving between them. He was aware his mount was drifting outwards and had he known ALPINE HEIGHTS was there he would have straightened his mount.

In summary Mr Davidson said Mr Cropp was entitled to be where he was. He had been forced to check his mount, losing momentum and ground. Mr Walters stated he did not know Mr Cropp was there until he called out and was doing his best.

Reasons for Decision:

The Committee was satisfied that Mr Walters had allowed his mount to drift outwards causing interference to ALPINE HEIGHTS. Mr Walters had ample opportunity to correct his mount prior to the incident but had failed to do so.

Submissions for Penalty:

Mr Davidson said Mr Walters had taken immediate corrective action and placed the incident in the low to mid range. He said Mr Walters had an excellent riding record and had not appeared before a committee for over 12 months. He had approximately 300 rides last season and about 100 rides this season. However, as a result of the interference there had been a protest and a change of placings. He sought a suspension of 2/3 South Island days.
Mr Walters said his record was very good. He was committed to rides at the Greymouth meeting on January 4th. He did not seek a deferment of penalty.

Reasons for Penalty:

The committee gave credit for Mr Walters’ excellent riding record. We viewed the incident as mid-range, due to the change of placings in the previous protest hearing. The committee believed a three day suspension was appropriate.
