Mr Stackhouse admitted a breach of rule 638(1)(d), careless riding, in that he allowed his mount Mr TED at the 250 metres mark in Race 4 to shift in when not clear, causing interference to WHODATAP, and VOODOO VIXEN to check. The charge is therefore proved.

We have viewed the incident on 3 video angles and are of the view that Mr Stackhouse’s error lay in hitting Mr TED, who was shifting ground, a 2nd time with the whip, which caused that horse to lay in further. The result was crowding to WHODATAP and a check to VOODOO VIXEN.

Mr Davidson described the breach as low to mid range and asked for around 3 days suspension. Mr Hazlett, who assisted Mr Stackhouse, stated that Mr Stackhouse would learn from the experience of being in the room for the first time and asked for any suspension to commence as soon as possible.

We agree the incident is at the lower end for a breach of the careless riding rule. This is Mr Stackhouse’s first breach of any rule in 3 years of riding. He has also readily admitted the breach. We are aware of the need for consistency. We have previously imposed a penalty of 2 days suspension for a breach of this rule by Mr M, an apprentice with similar experience to Mr Stackhouse and who had a similar record. We believe an excellent record such as that that Mr Stackhouse possesses should be reflected in the period of suspension. Accordingly, we reduce what we believe to be an otherwise appropriate suspension of 3 days to 2 days. However, we draw to Mr Stackhouse’s attention that he will no longer be able to claim in mitigation the fact that he has a clear record.

Mr Stackhouse is suspended from riding at the end of today’s meeting up to and including Saturday 9 January. This is one week and encompasses 2 South Island days.
