Facts:
Miss Gestain was charged with a breach or r 638 (1) (d) – careless riding – in that she allowed her mount RIVERFALLS to shift inwards when not sufficiently clear of SOLOMON resulting in interference near the 300 metres in Race 5.
Miss Gestain admitted the breach and appeared at the hearing assisted by Mr P Harris and Mr D Walsh.
Mr Oatham with the use of the video replays, stated that RIVERFALLS was racing one-out and behind the leaders on entering the home straight. When mounting a challenge Miss Gestain used her whip once resulting in her mount shifting inwards onto SOLOMON which was crowded. Miss Gestain did not correct her mount and as a result SOLOMON was checked and lost its position.
Mr Walsh stated that Miss Gestain did not have her mount balanced properly before using the whip. He said it was inexperience on her part. Miss Gestain accepted she had made a mistake.

Mr Davidson stated that Miss Gestain had just started riding and had had about 20 rides. She is an apprentice jockey and this was her first breach of the careless riding rule or any other rule. The stewards sought a starting point of five days.
Mr Harris said Miss Gestain had confirmed rides on the second day of the meeting on 29th November and would like a deferment of penalty until after that date.
Reasons for Penalty:
The interference in the home straight was low to mid-range and we take a starting point of five days. Miss Gestain requested a deferment of penalty and that is granted. This is Miss Gestain’s first breach of any rule and she admitted the breach at the outset. However, as Miss Gestain is a South Island jockey any suspension must include a South Island race date.
