Miss Collett’s Apprentice Jockey’ licence was suspended for the period from after the conclusion of racing on Sunday, 10 April 2011, up to and including Wednesday, 20 April 2011 – effectively, 5 riding days. The Committee, in fixing this term of suspension, accepted that Miss Collett is a national rider.

Charge:

Following the running of Race 7, nztba.co.nz Promotes South Island Breeders Rating 80, an information was filed by Stipendiary Steward, Mr M R Davidson, against Licensed Apprentice Jockey, Miss A B Collett, alleging a breach of Rule 638 (1) (d) in that Miss Collett, as the rider of OPTIONS in the race, “allowed her mount to shift inwards near the 100 metres causing SANDIE (L M Allpress) to check”.

Miss Collett was present at the hearing of the information with Licensed Jockey, Mr R J Hannam. She indicated that she admitted the breach. The breach was found proved accordingly.

Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
    (d)  careless.

Facts:

Mr Davidson had Stipendiary Steward, Mr J M McLaughlin, show video replays of the incident with approximately 100 metres to race. He pointed out Miss Collett riding OPTIONS with SANDIE, ridden by Mrs Allpress, on her inside. He pointed out Mrs Allpress then stand up and have to check out of her position when OPTIONS, being pushed into a gap by Miss Collett, shifted inwards. Miss Collett briefly got her whip caught up in the mane, which was a mitigating factor, Mr McLaughlin said.

Miss Collett confirmed that she did get her whip caught in the mane when she was pushing the horse out. She admitted that she gave it “a couple of hits” and it did run in. She was preoccupied with getting the whip out of the reins rather than straightening her mount, Miss Collett said. While she did make an attempt to straighten her mount it was “probably just a bit too late”.

Mr Hannam submitted that Miss Collett’s line had been dictated slightly by the horse on her outside. Miss Collett had quite properly admitted the breach, he said. He submitted that, having to free her whip, she had done rather well to “get off” Mrs Allpress, albeit “a stride too late”. Miss Collett showed initiative in attempting to “get off”.

Submissions for Penalty:

Mr Davidson informed the Committee that Miss Collett had been riding for 7 months. In that time, she had received three suspensions – in August 2010, February 2011 and March 2011 – all at North Island meetings. She had received a term of 4 days in each case.

Mr Davidson said that Miss Collett was a busy “national rider”. She has ridden extensively in the North Island and is now riding in the South Island. This breach was at the lower end of the scale, he submitted. She did get her whip caught up but she was riding her horse along at the time. She had pulled her mount off Mrs Allpress’s mount but it was too late.

Mr Davidson said that the Stewards were seeking a suspension in this case of 4-5 national days. This submission took into account Miss Collett’s admission of the breach and the mitigating factors.

Miss Collett was asked by the Committee if she had been engaged to ride a horse or horses during the next seven day period. She said that she had declared rides at the meeting of Counties Racing Club at Pukekohe on Sunday, 10 April. Miss Collett then requested an adjournment of the hearing to give her the opportunity to speak by telephone to her employer, her father Mr R D Collett.

On the resumption of the hearing, Miss Collett declared that she did not seek any deferment beyond 10 April of the term of any suspension 

Reasons for Penalty:

In determining penalty, the Committee took into account, as mitigating factors, Miss Collett’s admission of the breach and the matters, in the nature of mitigating factors, raised by Mr Hannam and accepted by Mr Davidson. The Committee agreed that the breach was at the lower end of the scale.

The aggravating factor was that this was the fourth breach of the careless riding Rule in the 7 months that Miss Collett has been riding. Miss Collett had received suspensions as recently as in February and in March. The penalty needed to contain a deterrent element.
