Decision: As a result of an incident in Race 2, apprentice jockey J R Todd was charged with careless riding pursuant to Rule 871(1)(d) of the Rules of Racing

The facts
--As a result of an incident in Race 2, apprentice jockey J R Todd was charged with careless riding pursuant to Rule 871(1)(d) of the Rules of Racing. Mr Todd admitted the breach of the rule, and the charge is proved accordingly. Mr Todd was supported in the hearing by licensed jockey Mr J Laking.

The allegation was that Mr Todd allowed his mount to move inwards on several occasions between the 1200m mark and the 600m mark, causing tightening to QUANTUM DUDE (A J Chesmar) and DREAM PRINCESS (K Williams).

Video coverage of the incident was shown by Assistant Stipendiary Steward Mr M Humphreys which demonstrated quite clearly how Mr Todd was endeavouring to place his mount in a favourable position when he was not his own horse length and another clear of trailing horses. The consequence of this was to cause tightening to QUANTUM DUDE and a check to DREAM PRINCESS.

Penalty decision
--Mr Ching submitted that the carelessness was at the lower end of the scale. He said that Mr Todd, a senior apprentice, has an excellent record, having only been warned once in the last 12 months for a breach of the careless riding rule. Mr Todd has a lot of rides and Mr Ching believed that a fine was an adequate penalty.

Mr J Laking in support, agreed that the carelessness was minor and a fine would be a sufficient penalty. However there was a compromise of rider safety. We must also take into account the fact that it is not customary for apprentices to be fined. When suspensions are imposed, the minimum period of suspension is three days. Therefore if we are to impose a fine we need to be satisfied that there are exceptional circumstances. By a very fine margin we are prepared to adopt Mr Ching's recommendation. The circumstances which lead us to impose a fine are:
