DECISION AND REASONS:
--Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 871(4) alleging Jockey Mr C. W. Johnson failed to arrive on course on time.
--Mr Johnson had indicated on the Information that he admitted this breach of the Rules and he confirmed this at the hearing.
--Stipendiary Steward Mr S. C. Ching gave evidence that Mr Johnson was not on the course by the required time of 40 minutes before the first race, and arrived shortly after noon. By that time a replacement jockey had been weighed out.
--Mr Johnson explained that he had left home in what he believed was plenty of time, but that he had been held up by traffic. Mr Johnson accepted that he had made an error of judgement.
--Penalty: In relation to penalty Mr Ching advised that Mr Johnson had not breached the Rules since he had renewed his licence this season. Mr Ching also advised that a breach of this Rule was not common and was usually met with a fine of between $100-00 and $150-00. Mr Johnson had no submissions to make on penalty.
--Taking all the above matters into account we were satisfied that a fine of
--$125-00 was appropriate and Mr Johnson was fined this amount.
