This Information filed by Mr R Sanders, relates to the Canterbury Racing meeting at Riccarton today, the 4 April 2009.  The reason for this is that the defendant, Mr P Moroney, is present at Te Aroha and not Riccarton.

This Information filed by Mr R Sanders, relates to the Canterbury Racing meeting at Riccarton today, the 4 April 2009.  The reason for this is that the defendant, Mr P Moroney, is present at Te Aroha and not Riccarton.

The charge comes pursuant to Rule 828(2) and Mr Moroney admits the breach.

Mr Sanders explained that Mr Moroney is presently setting up stables in the South Island, but in the meantime his horses are in the care of his employees and licensed trainer, Mr P Harris.  Mr Sanders said that his horse, DOWN THE BAY, was unfortunately left off the float when it left for the races.  As a consequence the horse had to be scratched.

Mr Moroney said he learned after talking to his staff at Mr Harris’ stable the horse was on the second list of horses to be floated to the races, but somehow got left behind.  He admitted it was embarrassing for his stable, but realized as the licensed trainer, the final responsibility was his.

PENALTY SUBMISSIONS:
Mr Sanders said there was really no precedent for this breach, but after considering Mr Moroney’s remorse and guilty plea he believed a $400 - $600 fine would be appropriate.

PENALTY:
The Committee considered all submissions, and in particular noted Mr Moroney’s guilty plea, his obvious remorse and willingness to recompense the connections of DOWN THE BAY for any losses incurred.

The Committee has also referred to the penalty guide for assistance and accordingly impose a fine of $500.
